Online Auction Bidder's Agreement Buyer agrees to immediately enter into a Purchase Contract if declared the winning bidder by the auctioneer during the following auction: Property located at 410 White Oak Drive, El Dorado Springs, MO By signing up for this auction, I agree that I have read and fully understand the Online Bidder's Agreement and the Terms and Conditions of this auction. As a bidder, it is solely my responsibility to contact the auction company at 417-264-7288, or auctioneer at 417-270-7164 (Kristie Rackley) with any questions regarding the auction, purchase agreement, or terms and conditions prior to placing any bids in said auction. Online Auction Terms & Conditions Confirmation Auction: The property is being sold at “Reserve” Auction to the highest bidder, in an Online Only Bidding Auction. Bidding Registration: Online bidder hereby agrees that they must properly register for this online auction by completing and signing the (Online Bidders Agreement), and returning it to the auction company before placing bids online. The agreement can be emailed to the auction company at auctions@unitedcountryteam.com. Digital signature(s) can be obtained at the request of buyer. Contact auctioneer for details. Bidding Opens/Closes: The Online Only Auction (ie. Internet Auction), bidding shall be opened and begin closing on the dates and times stated above. Sale Prior to Auction End: Seller retains the right to enter into an acceptable sale contract prior to the auction ending. Should this occur, any and all active bids become void and the auction will immediately end. Property Previews: are available during the advertised property preview dates, or by contacting the auctioneer to set up showing. It is highly recommended that all bidders personally inspect the property prior to placing any bids in the auction. Property inspections are the sole responsibility of the bidders and can be arranged by contacting the auctioneer above. All property inspections must be set up in advance by the auctioneer. Cash Offer/No Financing Contingency: By participating in this auction, bidders hereby agree that their bid shall NOT be subject to the bidder’s ability to obtain financing. By placing a bid in this auction, bidders are making a “cash offer” to purchase the property. Financing is NOT a contingency in the purchase agreement and all financing must be arranged prior to bidding. Buyer’s Premium: a __0__ Percent (__0_%) Buyer’s Premium shall be added to the final bid price placed online, which will determine the Total Contract Sales Price. Bidders hereby understand that the Buyer’s Premium shall be added to their winning bid to create the Total Contract Sales Price for which they are obligated to pay for the property. Purchase Contract: Winning bidder hereby agrees to enter into a Contract to Purchase the property immediately upon being declared the Successful Bidder by the Auctioneer. Upon the close of the auction the winning bidder will be forwarded via email a Purchase Contract to Purchase the property. A signed copy of the Purchase Contract must be received by United Country – Cozort Realty, Inc no later than 24 hours from the time said Purchase Contract was sent to the winning bidder. The Purchase Contract may be hand delivered, faxed, scanned or emailed. Escrow Deposit: a non-refundable escrow deposit of Ten Percent (10%) of the total contract purchase price (which includes the buyer’s premium) will be wire transferred or hand delivered in the form of certified funds to the Title Company no later than 48 hours following the close of auction. Closing shall take place at Cedar County Abstract & Title, 105 East Spring Street, El Dorado Springs, Missouri. Out of state buyers will be afforded the opportunity to close via email, mail, or wire transfer of certified funds. Possession: Possession of the property will be given upon successful closing and transfer of title. Easements: The sale of the property is subject to any and all easements of record. Mineral Rights: The seller’s share of mineral rights (if any), shall be conveyed to the buyer at closing. Survey: Sellers are not required to provide a survey of the property. If the buyer desires a survey, it shall be at the buyer’s sole expense. Title Insurance: Title Insurance in the full amount of the purchase price will be split 50/50 between buyer and seller. Seller shall pay 2024 and all prior year real estate taxes. The 2025 real estate taxes shall be prorated to the date of closing.
