Auction Terms & Conditions

  1. Seller’s Confirmation
    The property is offered in a Public Auction. This is a reserve auction, and all bids are subject to final approval and acceptance by the Seller.

  2. Auction Bidding Registration
    Bidders must be properly registered by completing and signing the Auction Bidder Agreement. Registration may be completed via DocuSign or directly from the Broker/Auctioneer. Upon approval, bidding privileges will be granted.

  3. Auction Format

    • Online bidding opens as indicated, with live bidding starting on the date, time, and location above.

    • The auction uses a Round Robin, Multi-Round Single Tract Format. All 9 tracts will be offered individually.

    • Bidding occurs in rounds; no tract is declared sold until all rounds are complete.

    • After the first round, bidding reopens for any tract to increase bids.

    • Properties will be sold individually; no combination or group bidding is allowed.

  4. Agency Disclosure
    Brokers/Auctioneers act exclusively as agents for the Seller. They do not represent the Buyer. Any third-party broker is not a subagent.

  5. Property Preview & Inspection
    Bidders are strongly encouraged to inspect the property before the auction.

  6. No Financing Contingency
    All bids are cash offers. Bids are not contingent on financing.

  7. Buyer’s Premium
    A 5% Buyer’s Premium will be added to the winning bid to determine the Total Purchase Price.

  8. Purchase Contract
    Winning bidders must enter into a Contract to Purchase immediately upon Seller acceptance. The signed contract must be returned within 24 hours via hand delivery, fax, or email. A copy is available online prior to bidding.

  9. Down Payment / Earnest Deposit

    • Non-refundable down payment: 10% of Total Purchase Price

    • Payment due to Title Company within 48 hours of auction close

    • Remaining balance due at closing

    Delivered at closing, subject to the Deed, Title Commitment, and Sales Contract.

    Seller provides a Preliminary Title Commitment and a Special Warranty Deed.

  3. Taxes
    Seller pays prior-year taxes. Current-year taxes are prorated to closing.
